A Swindon contractor, Tonic Construction, has been fined £200,000 following the death of one of its drivers in an accident involving a forward tipping dumper.
Shaun Carter, an employee of Tonic Construction, was driving the dumper truck onto a spoil heap when the vehicle tipped over and he was killed, heard Cheltenham Magistrates’ Court.
In this type of dumper truck, the driver sits behind the load in an elevated position, often protected by a roll bar rather than a full cab.
On 31 May 2016, Carter’s truck became stuck on the edge of the spoil heap. He tried to jump clear of the vehicle, which overturned and crushed him. Carter died on the scene from serious head injuries.
A HSE investigation found that some of the spoil heap had earlier been removed by an excavator, leaving a sheer face.
